Terms of Use
October 15, 2026
These terms are the agreement between you and Wisper Studio, 10, Place de la cathédrale, 67000 Strasbourg, France (VAT number FR91851854091), contact: hello@heyasana.com (“we”, “Hey Asana”). By downloading or using the Hey Asana app (the “App”) you accept them. Nothing in these terms removes the rights you have as a consumer under mandatory law.
Apple and Google are not parties to this agreement. We, and not Apple or Google, are responsible for the App and its content, and for any claim about it, including product claims, compliance with legal requirements and intellectual property claims. Apple and Google have no obligation to provide maintenance or support for the App. These terms are meant to be consistent with the App Store and Google Play terms; if they conflict, the store terms apply to the points they govern. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
1. The App
Hey Asana helps you learn the names of yoga poses (asanas) in Sanskrit and in your language (English, French, German, Spanish, Italian or Portuguese), with illustrations, audio pronunciation and four types of exercises: flashcards, association, puzzle and sound. It also teaches the basic Sanskrit words those names are made of, lets you search poses, save favorites and generate exercises from them.
The App is an educational tool about vocabulary. It does not teach how to perform poses safely and is not medical, physiotherapy or yoga-teaching advice. Consult a qualified teacher or health professional before practicing.
2. Licence
We grant you a personal, non-exclusive, non-transferable and non-sublicensable licence to install and use the App on devices you own or control, under the rules of the App Store and Google Play (including Family Sharing where the store allows it). This licence also covers updates we provide, unless they come with their own terms.
You agree not to: copy, sell, rent, lend or redistribute the App; reverse engineer, decompile or modify it, or try to extract its source code, except as the law allows; extract and republish its content (texts, illustrations, audio) at scale; remove copyright notices; or use the App in violation of the law, or from a country or as a person subject to EU or US trade embargoes.
3. Free content and Premium unlock
Some content is free (currently the Backbends category of asanas, the Sun Salutation A flow and the Actions category of basic words). Locked content is shown with a lock icon.
The Premium unlock gives permanent access to all the App’s content and features on the account used for the purchase: all asanas, all basic Sanskrit words, all flows and exercises, the full search, favorites and exercises created from favorites. It is a one-time purchase, not a subscription: no recurring charge. Premium covers the content and features of the App as they exist, including the updates we publish; we may add content, and may change or retire features where there is a good reason, in line with our legal obligations.
4. Price and payment
The price is shown in the App, in your currency and with taxes included, before you confirm. It can differ between countries and can change over time; a price change does not affect purchases already made. Payment is processed by Apple or Google with your store account, under their terms. We do not receive your payment details.
You can restore your purchase on a new device with the same store account using “Restore purchase” in Settings.
5. Your rights as a consumer
5.1 Right of withdrawal
If you are a consumer in the European Union, you normally have 14 days to withdraw from a distance contract. When you buy the Premium unlock, the content is supplied immediately as a digital content. By confirming the purchase and asking for immediate access, you agree that it is supplied right away and acknowledge that you lose your right of withdrawal once the content is supplied (art. L221-28 of the French Consumer Code and equivalent rules in the EU). Apple and Google may offer their own refund processes, which are not affected.
5.2 Legal guarantee of conformity
We are responsible for any lack of conformity of the App or the Premium content. In France, the legal guarantee of conformity for digital content applies (articles L224-25-12 and following of the Consumer Code); consumers in other EU countries benefit from the equivalent rights under their own law. If the App does not work as described, contact us at hello@heyasana.com: we will bring it into conformity, and if that is not possible you may be entitled to a price reduction or to terminate the contract and be refunded. These rights cannot be excluded by these terms.
5.3 Free mediation
If we cannot settle a dispute, you may use, free of charge, a consumer mediator: [TO COMPLETE: name, address and website of the consumer mediator to which Wisper Studio is attached]. You must first have tried to solve the problem directly with us.
6. Support
We answer questions and bug reports sent to hello@heyasana.com, usually within a few working days. We try to keep the App working with current versions of iOS and Android, but we can’t promise that it will work on every device or on future system versions.
7. Your data
How we handle data is described in the Privacy Policy. In short: the App has no account, no advertising and no tracking, and keeps your favorites and settings on your phone; it sends crash reports to help us fix bugs.
8. Intellectual property
The App, its design, texts, illustrations, audio recordings and translations belong to Wisper Studio or its licensors and are protected by intellectual property law. The licence in section 2 is the only right you get. If someone claims that the App infringes their intellectual property rights, we (not Apple or Google) are responsible for dealing with that claim.
9. Liability
Nothing in these terms limits our liability for death or personal injury, fraud, intentional misconduct, or anything we cannot limit by law, including your consumer rights in section 5. Beyond that, and to the extent the law allows, we are liable only for foreseeable direct damage, and we are not liable for loss caused by use of the App outside its intended purpose, by changes you made to it, or by your device or software. If you use the App for business purposes, claims for defects expire twelve months after the App was made available to you.
10. Changes and termination
We may update these terms, for example when the App or the law changes. We will change the date above, and if a change is significant we will tell you in the App or on the website. If you do not agree to a change affecting the Premium content you purchased, contact us.
You may stop using the App at any time by uninstalling it. We may suspend access if you seriously breach these terms (for example by redistributing the content); your statutory rights remain.
11. Governing law
These terms are governed by French law. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live, and you may bring a dispute before the courts of your country of residence or before the French courts.
